Are there Tax Consequences if You Disclaim an Interest in Property from a Trust?

By Michael Pancheri Question: I am the primary beneficiary of a trust set up by my mother and my 2 daughters (ages 27 and 30) are also beneficiaries. The balance of the trust is to be distributed soon and my daughters want to disclaim any interest in it, so it will all go to me. My question is, what are the tax consequences of this arrangement? The total value of the trust is about $250,000. Thank you, L. Answer: Dear L - You are right in thinking that there may be some adverse tax consequences if your daughters disclaim their share of the trust. Although it is not clear from your question, I am assuming that your daughters acquired a 1/3rd interest in your mother’s trust upon your mother’s death. Generally speaking, when a person is designated as the beneficiary of an interest in property under a will or a living trust, the interest vests immediately upon the death of the transferor unless there is some other intervening condition that must be satisfied. The same is true for interests given to designated beneficiaries under retirement plans (including IRAs and 401(k) plans), annuity contracts, and life insurance policies. There are times, however, when a designated beneficiary doesn’t want the interest given to him or her, as is the case with your daughters. People in this situation often think that they can just refuse the interest and that’s the end of the story. They feel that way because, in their minds, they haven’t actually received anything and, therefore, they don’t actually own it. Unfortunately, the tax laws say otherwise. Once the interest vests in a designated beneficiary, the designated beneficiary is deemed to own it. From that moment on, any refusal or disclaimer of the interest by the designated beneficiary constitutes a gift of the present value of that interest for federal gift tax purposes. The gift is deemed to be made to the contingent beneficiary or beneficiaries designated under the governing instrument; i.e., the will, trust, etc. If that’s the case, then how would anyone ever refuse an inheritance without incurring a gift tax? The short answer is that, for many years, you couldn’t. If there was any consolation in the way the tax laws were written, it rested in the fact that the resulting transfer could be offset by the annual gift tax exclusion. Any excess over the annual gift tax exclusion could be sheltered from an actual out-of-pocket tax payment by the unified credit against gift and estate taxes. Even so, it was still a pain because you had to file a gift tax return and you lost all or part of your unified credit against future gift and estate taxes. In order to correct this problem, Congress amended the tax laws to provide for a qualified disclaimer as part of the Tax Reform Act of 1976. A “qualified disclaimer” allowed an individual to refuse an interest in property without being deemed to have made a gift of the interest. In that case, the individual was treated as though he or she had never received it - so there was no need to file a gift tax return, or to use a part of his or her unified credit, or even pay any gift taxes out-of-pocket. Still, in order to take advantage of the qualified disclaimer provisions, you have to satisfy the following requirements: (1) The disclaimer must be in writing. (2) The disclaimer must be given to the personal representative of the decedent’s estate or the trustee of the decedent’s trust, or to any other person holding legal title to property to which the interest relates, no later than 9 months after the later of (A) the day on which the transfer creating the interest in such person is made, or (B) the day on which such person attains age 21, (3) The person making the disclaimer must not have accepted the interest or any of its benefits. (4) And, as a result of such disclaimer, the interest must pass without any direction on the part of the person making the disclaimer, and passes either (A) to the spouse of the decedent, or (B) to a person other than the person making the disclaimer. So, Mrs. L, the good news is that your daughters can disclaim their interest in your mother’s trust without the transfer constituting a gift to you. However, they will have to meet the requirements set forth above, including the requirement that the disclaimer be made within nine (9) months after the transfer was made to your daughters. I am assuming that is nine (9) months after your mother’s death, but there may be other conditions in the trust instrument that actually delay the vesting of your daughters’ interests. For this reason, I would suggest that you consult with an experienced estate planning attorney because these requirements are unforgiving. The ending of a relationship, a close friendship, and the dreams that you shared with your significant other are just a few of the things you lose. So, when are you ready to move forward to a new relationship without any of the ill effects of your past relationship? You can ask yourself these questions. 1. You only think of your past significant other occasionally. They no longer occupy your thoughts. You cant move forward with someone new, if you are mentally focused on someone else. During a breakup your primary focus in on your ex, what could have happened, what if things were different, what if you would have said something at the right time. By [http://ezinearticles.com/?expert=Lawrence_Ebert] Lawrence Ebert An article by Jennifer Washburn in the April 12, 2006 issue of the Los Angeles Times entitled “The legal lock on stem cells;Two patents that cover key research areas are setting back science,” discusses patent royalty issues surrounding California’s Proposition 71/CIRM previously discussed in this ezine (”Future Bumps In The Road For State-Funding Of Stem Cell Research,” http://ezinearticles.com/?id=171034.) However, unlike the theme in the ezine, which suggested that patent royalty issues were bumps in the road which could be worked out, the Washburn article suggested that stem cell patents were themselves problematic. Washburn wrote: “The foundation’s [WARF's] patents are based on the work of James Thompson, a University of Wisconsin professor who was the first scientist to isolate embryonic stem cells, in 1998. But the patents are so broad — unreasonably broad — that they cover all human embryonic stem cell lines in the U.S., not just the specific lines developed by Thompson.” Obliquely, Washburn suggests that California’s CIRM should challenge the validity of WARF’s patents: “The Foundation for Taxpayer and Consumer Rights, based in Santa Monica, has urged California’s stem cell agency to challenge the Wisconsin patents.” The basic WARF patent is US 5,843,780 (issued 1 Dec 1998 to James A. Thomson, based on application 591246 filed 18 Jan 1996; the application was a continuation-in-part of U.S. application Ser. No. 08/376,327 filed Jan. 20, 1995. This invention was made with United States government support awarded by NIH NCRR Grant No. RR00167. Thus, if California’s CIRM were to challenge the ‘780 patent, one would have state taxpayer money of California used to challenge a patent held by a Wisconsin agency (WARF), based on research paid by for by the federal National Institutes of Health (NIH). It is doubtful that state taxpayers in California or in Wisconsin, or federal taxpayers, would find this a useful expenditutre of money. The previous ezine article stated: An important message to appreciate is that money from state-funding of stem cell research intended to create new horizons in medical treatment may be directed to paying off holders of already-created rights. It may well happen that there are valid patent rights in the stem cell area, and states working in the area must negotiate with the holders of those rights. Separately, the Hatch-Waxman Act created in 35 USC 271(e)(1) a safe harbor for research used to furnish information to federal agencies (such as the FDA). The Supreme Court gave this safe harbor great breadth in the case Merck v. Integra. Separately, it is ironic for Washburn to complain that WARF is asserting its patent rights while, at the same time, CIRM will be seeking to obtain patent rights to enforce against others. Although the patent royalty distribution under Proposition 71 is muddied by federal tax issues associated with the planned use of tax exempt bonds, California voters were told that there would be income from patent royalties. As a minor aside to the Washburn article, the two patents discussed therein, U.S. 5,843,780 and 6,200,806, were respectively a continuation-in-part and a divisional; because neither was a continuation, the remark about the applicant can file a “continuation” with another until it gets approved was inappropriate to these facts. The USPTO is currently studying changes to the “continuation” process, but even the changes, as currently proposed, would not have impacted these two applications. Discussions about the effect of repeated continuations on patent grant rate have been discussed in 4 CHI.-KENT J. INTELL. By Mellody Davis It is written in Proverbs 14:2 There is a way that seems right to man, but in the end it leads to death. It is also written in Proverbs 16:9 In his heart a man plans his course, but the Lord determines his steps. This leads me to the question. Who or what shall I believe. Lets look at what the Bible says about believing. In the book of John 6:28 it says Then they asked him, What must we do to do the works God requires? Jesus answered, The work of God is this: to believe in the one he has sent. Look at John 3:18 it says Whoever believes in him is not condemned whoever does not believe stands condemned already because he has not belived in the name of Gods one and only Son. This is the verdict; Light has come into the world, but men loved darkness instead of light because their deeds were evil. Everyone who does evil hates the light, and will not come into the light for fear that his deeds will be exposed. But whoever lives by the truth comes into the light, so that it may be seen plainly that what he has done has been done through God. Living in righteous is believing in Jesus. It says in the book of Romans 3:22 This righteousness from God comes through faith in Jesus Christ to all who believe. There is no difference, for all have sinned and fall short of the glory of God, and are justified freely by his grace through the redemption that came by Christ Jesus. God presented him as a sacrifice of atonement, through faith in his blood. He did this to demonstrate his justice, because in his forbearance he had left the sins committed beforehand unpunishedhe did it to demonstrate his justice at the present time, so as to be just and the one who justifies those who have faith in Jesus. Now look at Romans 10:9 it says That if you confess with your mouth, Jesus is Lord, and believe in your heart that God raised him from the dead, you will be saved. For it is with your heart that you believe and are justified, and it is with your mouth that you confess and are saved. As the Scripture says, Anyone who trusts in him will never be put to shame. For there is no difference between Jew and Gentilethe same Lord is Lord of all and richly blesses all who call on him, for, Everyone who calls on the name of the Lord will be saved. How, then, can they call on the one they have not believed in? And how can they believe in the one of whom they have not heard? And how can they hear without someone preaching to them? And how can they preach unless they are sent? As it is written, How beautiful are the feet of those who bring good news! Now look at Romans 16:17 it says I urge you, brothers, to watch out for those who cause divisions and put obstacles in you way that are contrary to the teaching you have learned. Keep away from them. For such people are not serving the Lord Christ, but their own appetites. By smooth talk and flattery they deceive the minds of nave people. Everyone has heard about your obedience, so I am full of joy over you; but I want you to be wise about what is good, and innocent about what is evil. It goes on to say at verse 25 Now to him who is able to establish you by my gospel and the proclamation of Jesus Christ, according to the revelation of the mystery hidden for long ages past, but now revealed and made known through the prophetic writings by the command of the eternal God, so that all nations might believe and obey himto the only wise God be glory forever through Jesus Christ! Amen There is a punishment for those dont believe. It says in the book 2Thessalonians 2:9 it says The coming of the lawless one will be in accordance with the work of Satan displayed in all kinds of counterfeit miracles, signs and wonders, and in every sort of evil that deceives those who are perishing. They perish because they refused to love the truth and so be saved. For this reason God sends them a powerful delusion so that they will believe the lie and so that all will be condemned who have not believed the truth but have delighted in wickedness. Now faith is being sure of what we hope for and certain of what we do not see. This is what the ancients were commended for. By faith we understand that the universe was formed at Gods command, so that what is seen was not made out of what was visible. Hebrews 11:1 In the book of James 2:18 it says But someone will say You have faith; I have deeds. Show me you faith without deeds, and I will show you my faith by what I do. You believe that there is one God. Good! Even the demons believe thatand shudder. It says in John 1:10 He was in the world, and though the world was made through him, the world did not recognize him. He came to that which was his own, but his own did not receive him. Yet to all who received him, to those who believed in is name, he gave the right to become children of Godchildren born not of natural descent, nor of human decisions or a husbands will, but born of God. Now in John 2:22 it says Then Jesus told him, Because you have seen me, you have believed; blessed are those who have not seen and yet have believed. In the book of Galatians 3:6 it saysConsider Abraham: He believed God, and it was a credited to him as righteousness. Understand , then, that those who believe are children of Abraham. The Scripture foresaw that God would justify the Gentiles by faith, and announced the gospel in advance Abraham; All nations will be blessed through you. So those who have faith are blessed along with Abraham, the man of faith. In the book of James 2:22 You see that his faith and his actions were working together, and his faith was made complete by what he did. And the scripture was fulfilled that says, Abraham believed God, and it was credited to him a righteousness, and he was called Gods friend. You see that a person is justified by what he does and not by faith alone. What a Blessing For Believing It is written in the book of Mark 9:23 it says If you can? Said Jesus, Everything is possible for him who believes. It says in Mark 11:22 Have faith in God, Jesus answered. I tell you the truth, if anyone says to this mountain, Go , throw yourself into the sea, and does not doubt in his heart but believe that what he says will happen, it will be done for him. Therefore I tell you, whatever you ask for in prayer, believe that you have received it, and it will be yours. Now look at Mark 16:16 it says Whoever believes and is baptized will be saved but whoever does not believe will be condemned. Now take a look at Matthew 5:11 it says Blessed are you when people insult you, persecute and falsely say all kinds of evil against you because of me. Rejoice and be glad, because great is your reward in heaven, for in the same way they persecuted the prophets who were before you. In the book of Ephesians 1:3 it says Praise be to the God and Father of our Lord Jesus Christ, who has blessed us in the heavenly realms with every spiritual blessing in Christ. For he chose us in him before the creation of the world to be holy and blameless in his sight. In love he predestined us to be adopted as his sons through Jesus Christ, in accordance with his pleasure and willto the praise of his glorious grace, which he has freely given us in the One he loves. In him we have redemption through his blood, the forgiveness of sins, in accordance with the riches of Gods grace that he lavished on us with all wisdom and understanding. At Ephesians 2:6 it says And God raised us up with Christ and seated us with him in the heavenly realms in Christ Jesus, in order that in the coming ages he might show the incomparable riches of his grace, expressed in his kindness to us in Christ Jesus. They could hardly expect their neighbour to forget the omission when the neighbours daughter married the next year. Even if your neighbours were the type of people you didnt particularly want to cultivate as friends, since travel was not a matter of jump on a plane and be there an hour later, if you didnt have your neighbours over to celebrate with you, youd end up with no guests at all. So, in effect, a wedding in the district was assumed to be the districts wedding, and everyone was automatically invited by virtue of living in the district. There was no formal invitation. People just arrived. And if it trapspired that on the day you found that your guests weren’t as many as you hoped for, you might send your servants out to all the the local establishments and invite perfect strangers to come and have some free beer instead of having to pay for it. The emphasis was not so much on who you invited, but that you used your celebration as a sort of announcement of your good fortune to all and sundry.
